Laura Zdychnec,Elder Law Specialist at Long Reher and Hanson wrote and executed a will for my elderly ailing mother. My mother, Sandra Cwayna Halla had been diagnosted with severe Alzheimer's Disease by Mayo Clinic Neurologists. My mother died in a memory care facility 4 months later from complications of Alzheimer's.
$250,000 dollars in legal fees later the Hennepin County Judge threw out the will. The judge explained that the evidence was ""clear and convincing"" that my mother did not have the capacity to execute a will. In his ""Findings of Fact"", the judge cited a number of points at which Laura Zydnech could have assessed my mother's mental capacity, but did not.
According to the Judge, Court File No. 27-PA-PR-10-45 Ms. Zdychnec did not ask about the Alzheimer's disease nor question Ms Halla's cognition. Ms. Zdychnec, although informed about the diagnosis on intake paperwork, never asked if any diagnosis had been made, never asked who was treating her, never asked for my mother's medical records.
