When I and my girlfriend went to put a hold on an apartment on 7/7/2011, Nita Robles-Cruz (Community Manager) told us that there was no application fee but a $50 hold would be needed to ensure the apartment for us until 8/15/2011. On the Deposit to Hold Agreement it is stated that there is a hold deposit of $0.00 and a $50.00 non-refundable application fee. When we asked Nita about the discrepancy she said that it would look like that, but that the charge would be credited as a hold still. On 7/9/2011 Nita called to tell us that our combined application had been declined because of a ?past eviction? (which was not actually an eviction at all); we then asked if one of us was approved could the other be put on the lease as soon as the debt was settled, the answer was ?yes?. I was approved on 7/14/2011 and told that the apartment was mine and as long as my girlfriend?s debt was settled by 8/15/2011 she too could re-apply and be approved to sign the lease same day with me. She was told that if she was not on the lease immediately she would have no authority to get the mail, call for maintenance, or get lock-out assistance, but she would still be able to reside in the apartment. On 8/1/2011 Lee-Ann of Colores Del Sol called me saying she was going through files and noticed mine saying there was still documentation needed to be approved for the apartment that we applied for together and also that new management had taken over. I had then told her that I was approved and the whole story behind that. What she told me was contrary to Nita?s original statement that although my girlfriend would have ?no rights? she could still live there; Lee- Ann said that if my girlfriend was staying there I would be in violation of their rules and be evicted. She openly spoke my girlfriend?s collection being the reason why we could not be there together but if we had documentation in by 8/13/2011 that we would possibly have a chance to be approved together by 8/15/2011. If my girlfriend was not approved by that date she could re-apply in 6 months, but be homeless in the meantime. The office staff was incredibly rude to us and completely incompetent in explaining anything and any ways to fix the situation as no one was not even allowed to get a cosigner. All we wanted was the truth and we were constantly lied to and their stories were changing all the time. It has been a terrible experience dealing with Colores Del Sol and highly discourage any people from having anything to do with this company. The Deposit To Hold Agreement specifically states: ?The holding deposit is refundable if my application was not approved (14-day delay required for processing deposit refund) payable to the party(s) completing this application.? We feel that this is warrant enough to get our money back, although management is currently fighting us on this.
