Read the fine print on the back side of the document before you sign it. Flood Brothers auto-renewal after 1 year of service is 5 years unless you notify them by certified mail 90 to 180 days before the end of the first year. \r

Our company has an original copy of the disposal agreement signed by Shawn Flood & our President on 3-23-10 for weekly waste disposal from 5-1-10 to 5-1-11 with no extensions and no contract period and nothing on the back side of the document. Service has continued since then without a contract. On 12-30-13, we informed Patrick Flood that we wanted to discontinue waste disposal service immediately. Patrick Flood indicated we had a contract that automatically renewed for 5 years on 5-1-11. Patrick Flood emailed us a copy of his version of the 3-23-10 contract which looks quite different than the original document we have in our possession. We faxed the document in our possession to Patrick Flood. He claims that Shawn Flood (the salesman that signed the agreement) left us with the wrong copy of the agreement and sent a certified letter to us threatening suing us for breach of contract if we didn't pay $1,053.00 as liquidation of damages by 1-9-14. \r

We instructed Patrick Flood to remove their waste container from our property without delay. He is refusing to remove the container until we pay the $1,053.00. His other threat is to sue us for $4,095.00 for liquidation damages.\r

Flood Brothers Disposal has been charging $1,521 annually (117.00 every 4 weeks x 13) for weekly removal of a 2 cubic foot disposal container. Last week, they quoted cost would be $85.00 per 4 weeks ($1,105/yr) if we switched to monthly pick up which would be adequate for our needs. \r

We did some price shopping. We are considering a quote for $55.00 per month ($660 annually) for pick up every other week (26 times per year) for the same size container based on 12 month agreement with 60 days notice. \r
