I wrote to express my continued disappointment with this firm and to seek a refund of the money they wasted on Byrnes V Miller.
We told our story about PARNSEN BLAKELY of Watkins Blakely & Torgerson (to try to get help) to Chapman University law school ethics professors, And they said: “I’ve seen it before. The first mistake you made was telling them your budget. Once they know that, they just divide your money by their hourly rate and arrive at the conclusion you should settle for next to nothing when your budget is spent.” We also told them about BLAKELY telling us he had juice with the mediation judge Hayden, because Blakely took his workshop at Oxford, making sure we understood this little secret.
I read over the motions and filings and was in the room for meetings and BLAKELY wasted a hundred paid-for hours spent with HIS expert witness David P. Ostrove, to compile the damage schedules. BLAKELY and OSTROVE first estimated damages at around $610,000, then they amended it to $485,000, then amended to $312,000. All of this is in records emails and letters from PARNSEN BLAKELY.
Then BLAKELY brought us the realization at mediation that all the insurance would settle for was $29,999 ($1 under the legal reporting amount as established by the California Board of Accountancy). Right after mediation, after all that PARNSEN BLAKELY sends a bill for…you guessed it over $29,000.
At mediation BLAKELY acted confused, seeming like he misplaced files on his laptop or couldn’t recall or read the work he did, then he told me the damages he estimated and the filings he did were used, ‘for posturing’ were his words. He told us his work was “posturing”! WE FIRED HIM.
So 6 months of calculations with David P. Ostrove, and a negligence per se motion produced by Watkins Blakely & Torgerson “ its all for posturing’… like YOUR work isn’t really “real’… It’s for “posturing’ as BLAKELY said.
You know what David P. Ostrove did? He refunded his $10,000 retainer. David P. Ostrove refunded his retainer.
