I bought a car on 9-4 from Austins Affordable Autos for 5103.75. I put 2500 down and was to pay 2603.75 on the 9-18. My father passed away a few months ago and I had to pay for his probate attorney, so I could not pay the second payment on time. 9-20 I called and spoke with Darrell and Michelle they say they would help and to come in. I did they agreed to put me on a 4 month contract at 32% interest yes it is high but I did not have any problem with it because I knew I would pay if off within a month or two. We signed it and I was waiting to give them 603.75 as agreed when Michelle got off the phone. The owner called and said no! to the contract that was already signed. Michelle asked me to give back the contract I thought I should not give it to her but I felt sorry for her so I did! She said to give her a couple of days to talk with the boss. no call 9/21 so I called them back on 9/22 and was told no! they would not give me more time. I told them again I would bring the car back if they will give me my 2500 back! they said no it doesn't work that way! so I asked again for 30 days PLEASE! Darrell said he would call me back, he did not. I called again on 9-23 they said they could not do anything to help me because the boss said no! about a week later I got a call from a man who said he was the person that helps with these types of problems. So we spoke for about 20 minuets I told him the whole thing. And again said I would give the car back if I could have my 2500 back because it is just to much money to walk away from... or I needed 30 days to pay it off. I also told me we have not driven the car it has just been sitting because it needed tires and I wanted to pay if off before I bought tires... he said he would call me back... he never did. 10-27 I called and spoke with Mat the manager! she said they have already filed a lawsuit and that there repo man signed a statement saying we said "" we would never give the car back. that it was hidden and they would never get it back"" Matt also said he has had a repo mam to our house 10 times! I told Matt To our knowledge NOONE has been to our house, we have never talked to any person at our house about our car. we never said we would not give the car back. we have not hidden the car it is and always has been at our house in our garage. we still have not driven it. Matt told me that if I pay a 200 repo fee and 175.00 court filing fee he would drop the law suit... I told our attorney this situation and he asked to see the lawsuit so I called Matt today 10/28 and asked him to fax a copy to my attorney and was told ""no he would not fax the lawsuit, he was doing me a favor buy giving me this deal and if I want to bring attorneys into it he would see me in court! then hung up on me. I have contacted the WA attorney general, WA DMV. I have been trying to work this out since two weeks after I bought this car, I really don't understand how a businessman would turn down someone that wants to give them money! So yes I guess I will see him in court...
